In consideration of the services to be performed by the manager the owner agrees to pay the manager the commission also set out in the schedule. The owner agrees as follows: I / We hereby appoint you to act as our exclusive agent and to manage our property, referred to in the schedule. I / We do authorise you to recite my / our name as the principal on any tenancy agreement you may prepare and any other relevant document you may sign on my / our behalf. I / We acknowledge that with this appointment you are to act as if you were the landlord and to do all things on our behalf, necessary to manage the property effectively. I / We as owners agree that the information I / we supply to you in this authority and schedule is correct. I / We agree to pay the $400.00 plus GST ($460.00) fee in advance to cover your advertising costs on Realestate.co.nz & TradeMe, time to view, photograph, video, show prospective tenants through the property and includes extensive online searches for suitable prospective tenants. I / We understand that this fee is non refundable and no advertising will be carried out until the fee is paid to account number 06 0601 0243606 00. In particular I / we authorise and instruct you to do the following when requested: To advertise for tenants and after checking the background of the successful applicants to select the most appropriate tenant on merit. To use an appropriate residential tenancy agreement (RTA) form. To rent the property on a fixed term tenancy basis at periods that best suit the market, where fixed term is appropriate. To conduct and record an initial property inspection at the commencement of a new tenancy if selected in the schedule. To conduct and record a routine inspection from time to time as requested. To collect a bond from the tenant equivalent to four weeks rent and to pay it to the Bond Collection Division of the Department of Building and Housing when employed to select a tenant. To collect the first weeks rent, deduct your fees and pay out the remainder as appropriate. To collect rental payments, if requested, as and when they fall due for payment and to take whatever steps are required by you to follow up and compel payments of unpaid rent. To negotiate with contractors and supervise all remedial or maintenance work at the tenancy premises whether that work is occasioned by the tenant or not. Managers Responsibilities & Restriction on Liability The manager shall have the duty to carry out the responsibilities set out herein and shall carry out those duties to a standard of care of a reasonable property manager. The owner agrees that the manager is not responsible for any arrears of rent incurred before or after the date of their appointment and is not liable to the owner for any damage caused by any party. The Manager has no responsibility for any injury to persons and/or damage to property arising out of the condition of the premises or any hazard in or about the premises. The manager will take due care in the performance of their contractual obligations but does not warrant the tenants performance in the payment of rent nor the observance of other covenants. Conflicting Instructions I / we agree that if I / we should instruct the tenants to pay the rent to anywhere other than your office, while employing you to collect the rent, then you may at your discretion terminate this agreement and I / we shall be liable for the commission due to the manager. Where there is more than one owner and you receive conflicting instructions as to the accounting of rent monies then I / we agree that you shall be at liberty to hold all rent monies in your trust account until the conflict has been resolved.Indemnity Provisions The owner agrees to indemnify and keep its manager and any contractors employed by the manager protected from all costs, claims, demands, suits, legal proceedings, or loss howsoever occurring incurred in the proper management of the tenancy premises and to reimburse the manager upon demand for any expenses incurred in the management of the premises. The owner takes full responsibility for the day to day management of the property and understands that all tradespeople working on their property must be qualified for the particular job they are undertaking and hold suitable & current public liability and professional indemnity insurance's. If in the managers sole discretion it may be necessary or 'proper' to reserve or withhold owners funds to meet obligations, which are or may become due (including the managers compensation) then the manager may do so at their discretion. Amendments Repairs I / we agree that the manager must obtain my / our consent to any repairs that may be required and the cost of repairs charged to my account with the particular trades person. or If you are collecting the rent on my behalf, these repairs are to be paid from rent collected on my behalf and administered by B&N Properties. It is acknowledged that any invoice for work arranged on my behalf with creditors is my responsibility and if there is not enough rent to cover the invoices, I will forward payment to you immediately upon demand. Insurances Building Insurance - The owner agrees to arrange any insurance on the rented dwelling. I / We acknowledge that I / we will contact our insurers to notify them that the property is now tenanted; to ensure that at all times the property is fully insured. Default Tenant Databases I / We understand that the manager utilises default tenant databases to access information about potential tenants for the purpose of reference checking.Notices This agreement shall only be terminated as follows: By the Owner, giving of three months notice in writing (including email to agent email address) delivered to the managers address for service referred to in this agreement or to any address commonly and usually used for correspondence or email By the Manager delivering to the Owner at the owners address for service notice in writing (including email to an email address) of any time period being not less than 14 days and not longer than three months however: If the Manager reasonably believes that there is a clear and present risk of harm to the tenant, in continuing to live in the rented premises and that risk cannot be immediately abated or removed, then the manager reserves the right to terminate this agreement forthwith by any means of communication available to them. The Manager may at the managers discretion alter the rate of any of the charges herein by giving two months notice in writing to the owners address for service.Amendments Statements If you are collecting the rent: I / We understand that the manager will send me statements as soon as possible after their balance date at the end of each month. I / We understand that the manager will provide me / us with an annual financial report, for the period that they hold the management of my property. The manager shall account to the owner for the rental received monthly and all payments made on the owners behalf within 5 working days of the close of the preceding month. In the event that the disbursements shall be in excess of the rents that are collected by the manager the owner agrees to pay such excess promptly upon demand.
